A New Generation of Refugees

Canada has a well-developed reputation for being a nation of bleeding hearts. We proudly helped smuggle black slaves past our borders when slavery was still active in the US and now it seems we can also be proud of the fine job we are doing to liberate the masses of Americans affected in the appalling war on porn. This week, the Toronto Sun published an article about Canada’s newest porn refugee.

Scott Michael Austin (aka. Kid Vegas) has fled to Canada to avoid being persecuted for a possible sexual assault. Although the courts say that the incident has nothing to do with work, he is actually being accused by one of his porno co-stars. In addition to this, his mother doesn’t believe that he has the chance of a fair trial because of the following factors:

…the only two defence attorneys in Beatty worth their salt dropped the case because one knew the accuser as well as her mother, and the other knew the accuser’s entire family.

As for the judges, she said, one has a niece who is a witness for the prosecution, and the other supposedly has the accuser’s mother on the county’s payroll.

Needless to say, this is a very small town!

So, what will Canada do with their new porn refugee? For the past few months, Kid Vegas has been held in detention centers in Ontario and has been marked “removal ready” by the border service. We’ll just have to wait and see whether he is sent back to Nevada…

This is not the first time Americans have attempted to escape their home country to the Great White North. Attempts of this kind have been made by soldiers trying to escape deployment abroad and homosexuals trying to move to a more gay-friendly environment where same-sex marriage is now legal.

Well, all I can say is “I’m proud to be an American Canadian where at least I know I’m free!

OK, how the hell does one guy manage to ‘rape’ a whole group of women? At least, that’s what I managed to understand from the article.

The small rural town where everybody knows eachother and possibly even related in one way or another , I’m not surprised Kid Vegas is considered guilty until proven innocent. It’s pretty obvious that he wouldn’t get a fair trial in that town.

Can’t he get the trial moved to a different US city?

The technical definition of “rape” is “she said no and he did it to her anyway.”

Maaaaaan. That must have been *some* party, even for Nevada! To make a very bad pun, it must have been one heck of a ho-down.

Even requesting a change of venue… this guy hasn’t a snowball’s chance in hell if the Judge is out to get him. Unless there are heaps of cameras in the courtroom. Not likely. Not in that small a town. He can request a change of venue, and the judge can deny it, and if he was convicted, then he could request a new trial on appeal. But he’d be in the (ahem) pokey the whole time… years, at least.

I understand that if the girl says “no”, legally it’s considered rape, no matter at what point throughout the act she says it.

What seems strange to me is that though the original accuser AND her friends that were at the party apparently ALL said ‘no’, nobody seemed to make a fuss at the moment. If I’m being done something against my will and my friends are somewhere around, I would either a) scream bloody murder, or b) mention it to them afterwards. But I guess they did neither, since more than one of them went through the act. Problem is, in a rape case, when it comes down to the accuser’s word against the offender’s, the accuser’s holds more weight… with good reason. Wouldn’t be the first time someone cried wolf for either personal revenge or monetary compensation though.

If he did in fact rape those girls, he deseves to be punished. No doubt about that. But looking at the facts presented in the article, I have a feeling that there’s much more to this case than what has been written. Either way, the guy still deserves a fair trial.

So who is he worried will persecute him?

“‘The allegation is that the sex he had with her during an escapade one night in Beatty was forced sex,’ said James Buchanan. ‘This comes from a girl who appeared with him in a porn movie. And, yes, there were other accusers, but they were all at the same party.’”

I agree that he is entitled to a fair trial but look at the rhetoric being thrown around about the alleged victim. I’m a bit more inclined to come down on the side of her rights at this point. If you are a porn star you can’t be raped? I think she is the one who is a lot less likely to get justice especially if this guy manages to stay in Canada.

    Ellie-

You’re right that the news article is a little rough around the feathers, but the reason for this is because the court will not acknowledge the fact that the accused has ANY RELATIONSHIP whatsoever to the defence. The blunt response is to show how idiotic it is to omit the working relationship that they do share.

Just like any man, he deserves a fair trial… especially if it means being put on a long list of sex offenders (which restricts people from living is certain areas of America). I can see why he’s worried…

    We shall see what happens…
